The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
Data protection is a fundamental right, which is why FABES Forschungs-GmbH would like to inform you in detail about the handling of personal data. Personal data is data that can be used to identify you personally.
This data protection declaration informs customers to what extent and for what purpose personal data is collected and processed.
Data collection and processing for accesses from the Internet
You can visit the website from FABES without having to disclose any information about your identity. In accordance with data protection regulations, we do not use tracking tools, automated decision-making or profiling. The browser used on your device automatically sends information to the FABES website’s server (e.g. browser type and version, date and time of access) in order to enable the website to establish a connection. This also includes the IP address of your requesting device. This is temporarily stored in a so-called log file and automatically deleted after 9 weeks.
The IP address is processed for technical and administrative purposes of establishing and maintaining the connection in order to ensure the security and functionality of the FABES website and to be able to prosecute any illegal attacks on it if necessary.
The legal basis for processing the IP address is Art. 6 (1) (f) GDPR. Our legitimate interest arises from the aforementioned security interest and the need to ensure the smooth provision of the website from FABES.

If you request or order analyses or other goods from FABES Forschungs-GmbH using the online contact form, the personal data provided (first and last name, company, e‑mail, telephone number, company address) will be stored in the FABES Forschungs-GmbH customer database once an order has been placed. You can also voluntarily provide your title, department, fax number and website

Your personal data will be processed at your request in accordance with Art. 6 (1) (b) GDPR, provided that you send FABES data in the context of pre-contractual fulfilment or an order. For general contact enquiries, FABES processes your data on the basis of legitimate interest of FABES in accordance with Art. 6 (1) (f) GDPR in the proper processing of your enquiry.
Your data will be deleted after the expiry of the statutory retention periods (usually 10 years according to the German Commercial Code/tax law), provided that no further claims are asserted or retention obligations prevent this.
Use of the data
In the case of access from the Internet, the automatically stored data is not used for analyses.
In the case of orders (via the Internet or by e‑mail) the data is only used for the purpose of fulfilling and processing the order and for customer surveys that are necessary for quality assurance as part of accreditation. Participation is voluntary.
In addition, in certain cases it is necessary to provide your company name to your suppliers in order to obtain specific recipe information about your samples. This information is then required for the preparation of a specific offer.
Rights of the data subject
You have the following rights vis-à-vis FABES with regard to your personal data:
i) Withdrawal of consent (Art. 7(3) GDPR)
You may withdraw your consent at any time with effect for the future. Data processing carried out prior to withdrawal remains unaffected.
ii) Information (Art. 15 GDPR)
You have the right to request information about whether and which personal data FABES processes about you. This includes, in particular, information on the purposes of processing, the categories of personal data, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of further rights (rectification, erasure, restriction of processing, objection), the existence of a right of appeal, information on the origin of your data (unless it was collected by us).
iii) Rectification (Art. 16 GDPR)
You have the right to request the immediate rectification of inaccurate personal data stored by FABES or the completion of your personal data.
iv) Erasure (Art. 17 GDPR, ‘Right to be forgotten’)
You may request the erasure of your personal data stored by FABES, unless its processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.
v) Restriction of processing (Art. 18 GDPR)
You have the right to request the restriction of the processing of your personal data if one of the conditions specified in Art. 18 GDPR applies.
vi) Data portability (Art. 20 GDPR)
You have the right to receive your personal data that you have provided to FABES in a structured, commonly used and machine-readable format or, where technically feasible, to request that it be transferred to another controller.
Exercising your rights
The rights mentioned here can be exercised free of charge at any time by telephone, e‑mail, fax or post without giving reasons (contact details: see section ‘Responsible body’).
Information on your right to object pursuant to Article 21 GDPR
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Article 6(1)(e) GDPR (data processing in the public interest) or Article 6(1)(f) GDPR (data processing based on a balancing of interests).
In the event of an objection, we will no longer process your personal data unless
i) FABES can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or
ii) the processing serves to assert, exercise or defend legal claims.
Please note that your right to erasure, rectification or restriction of processing may be restricted by statutory retention obligations or other mandatory legal requirements.
If your objection is directed against the processing of personal data for direct marketing purposes, we will immediately cease processing the data concerned for these purposes. In this case, it is not necessary to specify a particular situation.

Right to lodge a complaint with the competent supervisory authority
You have the right, pursuant to Article 77 GDPR, to lodge a complaint with a supervisory authority.
In the event of breaches of data protection law, the data subject has the right to complain to the competent supervisory authority. The competent supervisory authority for data protection issues is the state data protection officer of the federal state in which FABES is based (Bavaria). Cookies
So-called “cookies” are used on the FABES Forschungs-GmbH website. These are text files that are stored on your computer in order to optimise the provision of content. No personal data is stored in cookies.
This website only uses technically necessary cookies that are required for the operation of the website and its basic functions. No analysis or tracking cookies are used.

if this is necessary in accordance with Art. 6 (1) (b) GDPR for the performance of a contract with you or for the implementation of pre-contractual measures (e.g. transfer to accounting, project managers, external service providers, shipping companies).
2. Consent
if you have given FABES your express consent in accordance with Art. 6 (1) (a) GDPR.
3. Legal obligation
if FABES is legally obliged to disclose data in accordance with Art. 6 (1) © GDPR (e.g. to tax authorities or other public bodies).
If FABES uses external service providers within the scope of so-called order processing in accordance with Art. 28 GDPR (e.g. IT or hosting service providers), this is done exclusively in accordance with our instructions and in compliance with data protection regulations.
Your personal data will not be transferred to third parties for purposes other than those mentioned here.
Security
All data you submit personally is transmitted in encrypted form using the generally accepted and secure TLS (Transport Layer Security) standard. TLS is a proven and secure standard that is also used in online banking, for example. You can recognise a secure TLS connection by the ‘s’ appended to http (https://…) in your browser’s address bar or by the padlock symbol in your browser.
In addition, FABES uses appropriate technical and organisational measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction and unauthorised access by third parties. The security measures from FABES are continuously improved in line with technological developments and legal requirements.
