Data protection

The ope­ra­tors of the­se pages take the pro­tec­tion of your per­so­nal data very serious­ly. We tre­at your per­so­nal data con­fi­den­ti­al­ly and in accordance with the sta­tu­to­ry data pro­tec­tion regu­la­ti­ons and this pri­va­cy policy.

Data pro­tec­tion is a fun­da­men­tal right, which is why FABES For­schungs-GmbH would like to inform you in detail about the hand­ling of per­so­nal data. Per­so­nal data is data that can be used to iden­ti­fy you personally.

This data pro­tec­tion decla­ra­ti­on informs cus­to­mers to what ext­ent and for what pur­po­se per­so­nal data is coll­ec­ted and processed.

Data collection and processing for accesses from the Internet

You can visit the web­site from FABES wit­hout having to dis­c­lo­se any infor­ma­ti­on about your iden­ti­ty. In accordance with data pro­tec­tion regu­la­ti­ons, we do not use track­ing tools, auto­ma­ted decis­i­on-making or pro­fil­ing. The brow­ser used on your device auto­ma­ti­cal­ly sends infor­ma­ti­on to the FABES web­site’s ser­ver (e.g. brow­ser type and ver­si­on, date and time of access) in order to enable the web­site to estab­lish a con­nec­tion. This also includes the IP address of your reques­t­ing device. This is tem­po­r­a­ri­ly stored in a so-cal­led log file and auto­ma­ti­cal­ly dele­ted after 9 weeks.

The IP address is pro­ces­sed for tech­ni­cal and admi­nis­tra­ti­ve pur­po­ses of estab­li­shing and main­tai­ning the con­nec­tion in order to ensu­re the secu­ri­ty and func­tion­a­li­ty of the FABES web­site and to be able to pro­se­cu­te any ille­gal attacks on it if necessary.

The legal basis for pro­ces­sing the IP address is Art. 6 (1) (f) GDPR. Our legi­ti­ma­te inte­rest ari­ses from the afo­re­men­tio­ned secu­ri­ty inte­rest and the need to ensu­re the smooth pro­vi­si­on of the web­site from FABES.

If you request or order ana­ly­ses or other goods from FABES For­schungs-GmbH using the online cont­act form, the per­so­nal data pro­vi­ded (first and last name, com­pa­ny, e‑mail, tele­pho­ne num­ber, com­pa­ny address) will be stored in the FABES For­schungs-GmbH cus­to­mer data­ba­se once an order has been pla­ced. Your per­so­nal data will be pro­ces­sed at your request in accordance with Art. 6 (1) (b) GDPR, pro­vi­ded that you send FABES data in the con­text of pre-con­trac­tu­al ful­film­ent or an order. For gene­ral cont­act enqui­ries, FABES pro­ces­ses your data on the basis of legi­ti­ma­te inte­rest of FABES in accordance with Art. 6 (1) (f) GDPR in the pro­per pro­ces­sing of your enquiry.

Your data will be dele­ted after the expiry of the sta­tu­to­ry reten­ti­on peri­ods (usual­ly 10 years accor­ding to the Ger­man Com­mer­cial Code/tax law), pro­vi­ded that no fur­ther claims are asser­ted or reten­ti­on obli­ga­ti­ons pre­vent this.

Use of the data

In the case of access from the Inter­net, the auto­ma­ti­cal­ly stored data is not used for analyses.

In the case of orders (via the Inter­net or by e‑mail) the data is only used for the pur­po­se of ful­fil­ling and pro­ces­sing the order and for cus­to­mer sur­veys that are neces­sa­ry for qua­li­ty assu­rance as part of accre­di­ta­ti­on. Par­ti­ci­pa­ti­on is voluntary.

In addi­ti­on, in cer­tain cases it is neces­sa­ry to pro­vi­de your com­pa­ny name to your sup­pli­ers in order to obtain spe­ci­fic reci­pe infor­ma­ti­on about your samples. This infor­ma­ti­on is then requi­red for the pre­pa­ra­ti­on of a spe­ci­fic offer.

Rights of the data subject

You have the fol­lo­wing rights vis-à-vis FABES with regard to your per­so­nal data:

i) With­dra­wal of con­sent (Art. 7(3) GDPR)
You may with­draw your con­sent at any time with effect for the future. Data pro­ces­sing car­ri­ed out pri­or to with­dra­wal remains unaffected.

ii) Infor­ma­ti­on (Art. 15 GDPR)
You have the right to request infor­ma­ti­on about whe­ther and which per­so­nal data FABES pro­ces­ses about you. This includes, in par­ti­cu­lar, infor­ma­ti­on on the pur­po­ses of pro­ces­sing, the cate­go­ries of per­so­nal data, the reci­pi­ents or cate­go­ries of reci­pi­ents to whom your data has been or will be dis­c­lo­sed, the plan­ned sto­rage peri­od, the exis­tence of fur­ther rights (rec­ti­fi­ca­ti­on, era­su­re, rest­ric­tion of pro­ces­sing, objec­tion), the exis­tence of a right of appeal, infor­ma­ti­on on the ori­gin of your data (unless it was coll­ec­ted by us).

iii) Rec­ti­fi­ca­ti­on (Art. 16 GDPR)
You have the right to request the imme­dia­te rec­ti­fi­ca­ti­on of inac­cu­ra­te per­so­nal data stored by FABES or the com­ple­ti­on of your per­so­nal data.

iv) Era­su­re (Art. 17 GDPR, ‘Right to be forgotten’)
You may request the era­su­re of your per­so­nal data stored by FABES, unless its pro­ces­sing is neces­sa­ry for exer­cis­ing the right of free­dom of expres­si­on and infor­ma­ti­on, for com­pli­ance with a legal obli­ga­ti­on, for reasons of public inte­rest or for the estab­lish­ment, exer­cise or defence of legal claims.

v) Rest­ric­tion of pro­ces­sing (Art. 18 GDPR)
You have the right to request the rest­ric­tion of the pro­ces­sing of your per­so­nal data if one of the con­di­ti­ons spe­ci­fied in Art. 18 GDPR applies.

vi) Data por­ta­bi­li­ty (Art. 20 GDPR)
You have the right to recei­ve your per­so­nal data that you have pro­vi­ded to FABES in a struc­tu­red, com­mon­ly used and machi­ne-rea­da­ble for­mat or, whe­re tech­ni­cal­ly fea­si­ble, to request that it be trans­fer­red to ano­ther controller.

Exer­cis­ing your rights
The rights men­tio­ned here can be exer­cis­ed free of char­ge at any time by tele­pho­ne, e‑mail, fax or post wit­hout giving reasons (cont­act details: see sec­tion ‘Respon­si­ble body’).

Infor­ma­ti­on on your right to object pur­su­ant to Artic­le 21 GDPR

You have the right to object at any time, on grounds rela­ting to your par­ti­cu­lar situa­ti­on, to the pro­ces­sing of per­so­nal data con­cer­ning you which is based on Artic­le 6(1)(e) GDPR (data pro­ces­sing in the public inte­rest) or Artic­le 6(1)(f) GDPR (data pro­ces­sing based on a balan­cing of interests).
In the event of an objec­tion, we will no lon­ger pro­cess your per­so­nal data unless

i) FABES can demons­tra­te com­pel­ling legi­ti­ma­te grounds for the pro­ces­sing which over­ri­de your inte­rests, rights and free­doms, or

ii) the pro­ces­sing ser­ves to assert, exer­cise or defend legal claims.
Plea­se note that your right to era­su­re, rec­ti­fi­ca­ti­on or rest­ric­tion of pro­ces­sing may be rest­ric­ted by sta­tu­to­ry reten­ti­on obli­ga­ti­ons or other man­da­to­ry legal requirements.
If your objec­tion is direc­ted against the pro­ces­sing of per­so­nal data for direct mar­ke­ting pur­po­ses, we will imme­dia­te­ly cea­se pro­ces­sing the data con­cer­ned for the­se pur­po­ses. In this case, it is not neces­sa­ry to spe­ci­fy a par­ti­cu­lar situation.

Right to lodge a complaint with the competent supervisory authority

2. Con­sent
if you have given FABES your express con­sent in accordance with Art. 6 (1) (a) GDPR.

3. Legal obligation
if FABES is legal­ly obli­ged to dis­c­lo­se data in accordance with Art. 6 (1) © GDPR (e.g. to tax aut­ho­ri­ties or other public bodies).

If FABES uses exter­nal ser­vice pro­vi­ders within the scope of so-cal­led order pro­ces­sing in accordance with Art. 28 GDPR (e.g. IT or hos­ting ser­vice pro­vi­ders), this is done exclu­si­ve­ly in accordance with our ins­truc­tions and in com­pli­ance with data pro­tec­tion regulations.
